Who are we? John W. Phillips, the firm’s founder, honed his trial skills as a Los Angeles City Attorney and District Attorney. As a prosecutor, John conducted more than 150 jury trials including one against the Ku Klux Klan, which made headlines across the country and later became the subject of his best selling book, Sign of the Cross. John partnered with his son, Patrick, to form Phillips & Associates in 2011. Can I Afford a Lawyer?

We handle all of our cases on a pure contingency fee basis. This means our fee is a percent of your recovery, and if there is no recovery there is no fee. Our office will also advance all costs so you won't spend a penny out of your own pocket pursuing your case.

What is a Statute of
Limitations?

All personal injury cases have deadlines by which you must file a lawsuit or you lose the right to pursue your case. This deadline is called a statute of limitations. In California, the statute of limitations for MOST personal injury actions is two years from the date of the occurrence. However, there are exceptions in cases involving the government, cases involving medical professionals, and cases in which the plaintiff is a minor (among other exceptions). Consult with us immediately to determine what the statute of limitations is in your case.

What if I am Partially
At Fault?

You may still be entitled to compensation even if you are partially at fault. This is because California follows what's called the "comparative negligence" doctrine. This legal doctrine holds that even when an accident victim has some blame for their accident, they can recover compensation reduced by their percent of fault.

How Long Will My Case
Take?

How long your case will take depends on the duration of your medical treatment and the defendant's willingness to compensate you fully for your damages. Some cases we are able to settle very quickly, and in others we have to file a lawsuit, which can add several months or longer to the process.

How Much Is My Case Worth?

The value of your case depends on the nature of your injuries, your econmic (financial) damages such as medical expenses and lost wages, and liability. The at-fault party's insurance policy limit can sometimes be a factor in determining the amount you can recover, as well. All of this is to say that the value of your case depends on a number of variables which are not possible to know at the beginning of your case. We can count many instances of cases that have had seemingly very little value which, upon the discovery of additional facts, wound up being worth well into the six or even seven figures. We take a hands on approach to investigating all factors affecting case value and communicate these clearly to the client as their case develops.

Will I Have To Go To Court?

Not always. Sometimes we are able to settle personal injury cases by submitting a pre-litigation demand. In these cases, no lawsuit is ever filed and you never have to go to court. Even if we do wind up filing a lawsuit, there will be opportunities to settle your case before it goes to trial. And in the even your case does go to trial, we will prepare you extensively for your testimony and make sure that you are fully comfortable with the process.
